These are the Terms and Conditions of The Honest Shipper. Please read them carefully, understand them, and comply accordingly before contacting us
The Consignment Note of The Honest Shipper (hereinafter referred to as the “CN”) is non-negotiable. The Shipper/Sender/Client acknowledges that it has been prepared either by the Shipper/Sender/Client or by The Honest Shipper staff on their behalf. The Shipper/Sender/Client confirms that all information provided at the time of booking — including shipper and consignee details, goods value, and declarations — is complete and accurate.
The Shipper/Sender/Client warrants that they are the owner of the parcel/goods/cargo, or are authorized to act on behalf of the owner. In the event of any incorrect information or declaration in the CN, The Honest Shipper shall be absolved from any liability for loss, damage, or expenses incurred. The execution of the CN shall serve as prima facie evidence of the contract between the Shipper and The Honest Shipper.
These Terms and Conditions apply to all courier, logistics, and related services provided by The Honest Shipper. No employee, franchisee, agent, or representative of The Honest Shipper has the authority to alter these terms or make promises inconsistent with them.
The Honest Shipper reserves the right, but not the obligation, to inspect any shipment, including opening the package if required by law or regulation. The Shipper/Sender/Client agrees that such inspection may occur at any time at the company’s discretion. While reasonable care will be taken, The Honest Shipper shall not be liable for any damage or delay arising from such inspection.
The Honest Shipper shall have a lien over any goods shipped for unpaid freight charges, duties, taxes, or any other amounts payable. The company may retain possession of goods until all outstanding charges are settled.
In the event of loss or damage, the maximum liability of The Honest Shipper shall be the lesser of the following:
The actual value of the lost or damaged item as defined in Clause 6
Liability applies only where loss or damage is proven to be due to the negligence or willful misconduct of The Honest Shipper. Proof of such negligence is required.
The Shipper/Sender/Client agrees to indemnify The Honest Shipper against all claims, costs, damages, or liabilities arising from:
i) Breach of this agreement
ii) Injury, death, or property damage caused directly or indirectly by the Shipper or their agents
iii) Any claim exceeding the company’s stated liability limits
iv) Any attempt to hold The Honest Shipper directors, employees, or agents personally liable
The actual value of a document is the lesser of its preparation cost, replacement cost, or reconstruction value at the time and place of shipment.
The actual value of goods is the lesser of their preparation, replacement, repair, or fair market value at shipment. Under no circumstances shall this value exceed the original purchase cost.
The Honest Shipper shall not be liable for indirect or consequential losses, including but not limited to loss of income, profit, market, or use of contents.
While The Honest Shipper will make every effort to meet delivery schedules, it shall not be liable for delays caused by events beyond its control, including but not limited to:
These Terms and Conditions benefit The Honest Shipper, its affiliated companies, officers, and employees.
The Honest Shipper does not transport:
Currency, jewelry, antiques, liquor, stamps, precious metals/stones, contraband, works of art, firearms, plants, drugs, explosives, animals, perishable goods, bearer instruments, obscene materials, hazardous substances, or any items prohibited by applicable laws or international shipping regulations.
No insurance is provided unless expressly agreed in writing prior to shipment. Any insurance arranged will be subject to the insurer’s terms, will incur additional charges, and will not cover consequential losses.
The Shipper confirms that all goods were lawfully acquired and that no laws were breached. All necessary documents must be provided to The Honest Shipper upon request, and the Shipper shall indemnify the company against any legal or regulatory claims.
If charges are billed to a receiver or third party who fails to pay, the Shipper remains responsible for payment. The Honest Shipper may retain goods until payment is made.
If international carriage involves a destination or stop outside the origin country, the Warsaw Convention shall apply, potentially limiting liability.
Special handling, lifting equipment, or crane charges may apply. Charges will be based on the greater of actual or volumetric weight.
Rates are subject to fuel price fluctuations. The Honest Shipper’s decision on applicable surcharges is final.
Shipments cannot be delivered to P.O. boxes. Delivery will be made to the receiver’s address but not necessarily to the named individual. If delivery is impossible or refused, The Honest Shipper may return, dispose of, or sell the shipment without liability, applying proceeds against charges.
The Shipper agrees to all routing decisions, including use of intermediate stops.
These Terms are governed by the laws and courts of the shipment’s country of origin, unless otherwise required by law.
The Honest Shipper is not liable for certain losses, and where liability exists, it is strictly limited. Shippers are advised to purchase insurance. All duties, taxes, and levies remain the sole responsibility of the Shipper.
